Tobacco Laws Affecting California
This 2009 booklet (and a 2010 supplement) provides summaries of
tobacco laws that affect California. It is designed as a resource for tobacco control advocates, government attorneys, local law enforcement agencies, and anyone who is working on tobacco control issues.
The booklet includes information on California state laws and regulations related to tobacco, as well as on certain federal laws and regulations that apply within California. (It does not contain information on the numerous local laws in California that regulate tobacco use, sales, or distribution, many of which are stricter than state or federal law; for example, local governments in California have passed laws to limit exposure to secondhand smoke in both indoor and outdoor areas where smoking is permitted by state law.)
The 2010 supplement explains new restrictions imposed by the Family
Smoking Prevention and Tobacco Control Act of 2009, a federal law enacted by the U.S. Food and Drug Administration. The supplement outlines the scope of the restrictions, any exceptions, and enforcement mechanisms and penalties, and it notes where pending litigation may affect implementation.
The supplement is only available as a PDF, but printed copies of the 2009 booklet are still available upon request. To request copies, please fill out the form (and indicate your desired quantity) here.
