Law Notes: How to Prohibit Smoking in Owner-Operated Businesses

Under the state’s smoke-free workplace law (California Labor Code
section 6404.5), smoking is allowed in businesses that have no employees and are operated solely by the owners. Businesses, especially bars, have claimed they are owner-operated by recharacterizing employees as “coowners." This document explains whether or not this is permissible.
